Terms of Service

These Terms of Service are a legal agreement between you and Gwun LLC, a Florida limited liability company, operating the public brand USA Arms. These Terms govern your access to and use of USA Arms, including usaarms.com, our subdomains, APIs, map/tile services, accounts, forms, directory listings, reviews, calendar features, paid features, and related services.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

USA Arms is a U.S.-focused directory, map, search, listing, and community-information service for firearm-related businesses, organizations, services, events, classes, activities, and related information. USA Arms may include listings for ranges, shops, instructors, gunsmiths, ammo retailers, manufacturers, FFLs, and other entities.

• USA Arms does not sell firearms, ammunition, suppressors, accessories, training, transfers, background checks, shipping, FFL services, or any regulated items or services directly.
• USA Arms does not currently broker, arrange, or facilitate firearm, ammunition, suppressor, transfer, background-check, shipping, or FFL transactions between users and listed businesses.
• USA Arms is not a firearms dealer, broker, transfer agent, legal advisor, compliance advisor, safety trainer, or licensing authority.
• Any transaction, training, transfer, purchase, sale, service, class, appointment, background check, or other interaction between you and a listed business is solely between you and that third party.

You must be at least 18 years old to use the Service. The Service is intended for users in the United States. You are responsible for complying with all federal, state, local, and other laws that apply to your use of the Service.

Information on USA Arms is for general informational purposes only. USA Arms does not provide legal advice, firearm compliance advice, safety advice, licensing advice, transfer advice, business advice, tax advice, or regulatory advice.

Listings are a continuous work in progress. Listing data may come from public records, public datasets, public websites, web crawlers, manual research, user submissions, owner-submitted corrections, and other sources.

We do not guarantee that listings are accurate, complete, current, lawful, safe, available, categorized correctly, or suitable for your needs. We may add, edit, merge, remove, suppress, recategorize, rank, label, or display listings at our discretion.

If accounts are enabled, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it updated.

We may suspend, restrict, or terminate accounts at any time if we believe the account is inaccurate, unauthorized, abusive, unlawful, risky, inactive, or violates these Terms.

USA Arms may allow business owners, employees, representatives, or authorized agents to claim or correct listings. By submitting a claim, correction, verification document, or update, you represent that the information is accurate, that you have authority to act for the business or listing, and that your submission does not violate law, third-party rights, privacy rights, or these Terms.

USA Arms may review, approve, reject, edit, delay, or remove claims and corrections at its discretion. A claimed or verified listing does not mean USA Arms endorses, recommends, licenses, certifies, or guarantees the business.

The Service may allow users to submit, upload, post, or provide content, including reviews, ratings, comments, photos, logos, descriptions, business information, corrections, event details, messages, and files. You are solely responsible for your User Content.

• If reviews or ratings are enabled, reviews must be truthful, based on genuine experience, and not misleading. Fake reviews, undisclosed paid reviews, competitor sabotage, harassment, threats, spam, or rights-violating reviews are prohibited.
• Reviews and ratings are opinions of their authors, not USA Arms.
• If calendar, event, class, activity, subscription, alert, or notification features are enabled, event and class information may be incomplete, outdated, changed, canceled, or inaccurate.
• You must verify all event, class, schedule, location, price, eligibility, safety, and legal requirements directly with the organizer or business.

• USA Arms may offer paid listings, sponsored placements, featured placements, subscriptions, advertising packages, or other paid features.
• Paid or sponsored content should be labeled where required or appropriate.
• Payment for a listing or placement does not mean USA Arms endorses, certifies, recommends, guarantees, or verifies the business, product, service, event, or claim.
• Paid features do not guarantee traffic, leads, rankings, revenue, conversions, placement duration, search visibility, or results unless expressly stated in a written agreement.
• USA Arms may include affiliate or monetized links. If you click an affiliate link and make a purchase or take another qualifying action, USA Arms may earn compensation.
• Affiliate relationships do not control ordinary directory inclusion or ordinary listing order unless a placement is clearly labeled as sponsored, featured, advertising, or similar.

USA Arms may offer APIs, data exports, bulk data, map/tile access, or other data products. Unless you have a separate written agreement with USA Arms, you may not:

API and export access may be governed by separate API/Data Access Terms or a written agreement. If there is a conflict, the separate written agreement controls for that API/export access. We may suspend, throttle, block, revoke, or terminate access at any time.

• Violating any law or regulation.
• Facilitating unlawful firearm, ammunition, suppressor, accessory, transfer, shipping, background-check, or related activity.
• Harassing, stalking, threatening, intimidating, doxxing, surveilling, or targeting any person or business.
• Compiling targeted lists for unlawful, harmful, abusive, discriminatory, or threatening purposes.
• Submitting false, misleading, fraudulent, impersonating, or unauthorized information.
• Claiming a listing without authority.
• Uploading malicious code or interfering with the Service.
• Scraping, crawling, harvesting, overloading, reverse engineering, or bypassing technical controls.
• Spamming businesses, users, or USA Arms.
• Infringing intellectual property or privacy rights.
• Misrepresenting your relationship with USA Arms.

The Service, including its software, design, layout, database structure, compilation, maps, search, content, trademarks, logos, and other materials, is owned by USA Arms, Gwun LLC, or its licensors, except for third-party content and User Content.

The Service may link to third-party websites, businesses, products, services, events, or resources. USA Arms does not control and is not responsible for third parties. Your interactions with third parties are solely between you and them.

If you believe content on the Service infringes your copyright, contact us through Contact and include your name and contact information, a description of the copyrighted work, the URL or location of the allegedly infringing material, a good-faith statement, an accuracy and authorization statement, and your physical or electronic signature.

• Our Privacy Policy explains how we collect, use, disclose, and retain information.
• We may change, suspend, or discontinue any part of the Service at any time.
• We may update these Terms from time to time. Your continued use of the Service after updated Terms are posted means you accept the updated Terms to the extent permitted by law.
• We may suspend, restrict, block, or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms, created risk, caused harm, or used the Service in a way we do not permit.

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, USA ARMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND COURSE OF DEALING.

To the maximum extent permitted by law, USA Arms, Gwun LLC, and their owners, members, managers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost data, lost revenue, lost goodwill, business interruption, personal injury, property damage, legal violations by third parties, or third-party disputes.

To the maximum extent permitted by law, the total liability of USA Arms and Gwun LLC for any claim arising out of or relating to the Service or these Terms will not exceed $100. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. In those cases, liability is limited to the lowest amount permitted by law.

You agree to defend, indemnify, and hold harmless USA Arms, Gwun LLC, and their owners, members, managers, employees, contractors, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, your listing claims, corrections, uploads, or verification submissions, your violation of these Terms or law, your violation of third-party rights, your interactions or disputes with third parties, or your scraping, API misuse, data misuse, or prohibited use.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. To the maximum extent permitted by law, you and USA Arms agree to exclusive jurisdiction and venue in the state or federal courts located in Florida for disputes arising out of or relating to these Terms or the Service.

To the maximum extent permitted by law, you and USA Arms agree that each may bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative proceeding.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law.

These Terms, together with the Privacy Policy and any additional terms that apply to specific features, are the entire agreement between you and USA Arms regarding the Service. Use Contact for questions.
